Terms of Service

These terms cover what you get when you install a Peakify app or use peakifyapps.com, and what we expect in return. By installing an app or using the site, you agree to them.

The service

Peakify provides Shopify apps and related marketing pages. Features, pricing, and limits may change as we improve the product. We'll give reasonable notice for material changes that affect your plan.

Your account

You're responsible for what happens on your Shopify store and your Peakify account. Keep your admin access secure, follow Shopify's terms, and don't use Peakify to break the law or harm shoppers.

Billing

Paid plans are billed through Shopify on the schedule shown at checkout. Current plan, trial, and billing details are shown on the Shopify App Store and Shopify billing screens. You can change plans or uninstall through Shopify. Refunds are handled case by case; reach out and we'll review the request.

Acceptable use

Don't reverse-engineer the apps, resell access, run automated load against our infrastructure, or use Peakify for stores selling content that violates Shopify's Acceptable Use Policy. We may suspend accounts that do.

Your content & data

Your store data stays yours. We process it to run the features you enabled. See our Privacy Policy for the details. You grant us the limited license needed to operate the service on your behalf.

Availability

We aim for high uptime but don't promise the service will be uninterrupted or error-free. We schedule maintenance windows when impact is lowest and post incidents publicly when they happen.

Warranty & liability

Peakify is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.

Termination

You can uninstall any Peakify app from your Shopify admin at any time. We may suspend or terminate accounts for breach of these terms or for prolonged non-payment. On termination, your store data is scheduled for deletion within 30 days, as required by Shopify.

Changes to these terms

If we update these terms in a way that materially affects you, we'll post a notice and update the date above. Continued use after changes means you accept the new version.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes arising from these terms or your use of a Peakify app will be resolved in the courts located in Delaware.
